1. Introduction and Acceptance
1.1 Welcome to DigiTicket Africa
These Terms and Conditions ("Terms") govern your use of the DigiTicket Africa website, mobile applications, and services (collectively, the "Platform") operated by InfoByte Technologies (Pty) Ltd, a company registered in South Africa with registration number 2013/023025/07 ("DigiTicket," "we," "us," or "our").
1.2 Agreement to Terms
By using or visiting our Platform, you expressly agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Platform or services.
1.3 Legal Capacity
If you are not yet 18, you must obtain your parents' or legal guardians' advance authorization, permission and consent to be bound by these Terms prior to using our Platform.
1.4 Updates to Terms
We reserve the right to change these Terms at any time, effective immediately upon posting on the Platform. We may provide 20 business days' notice for material changes. Please check this page periodically. Your continued use after changes constitutes acceptance of the modified Terms.
2. About Our Service
2.1 Agency Relationship
DigiTicket acts as an authorized agent for event organizers, promoters, venues, and performers ("Event Partners") in the sale of tickets. We facilitate transactions but do not organize or produce events ourselves.
2.2 Platform Services
Our Platform provides:
- Online ticket sales and distribution
- Digital ticket delivery and storage
- Customer support for ticket transactions
2.3 Third-Party Integration
We may integrate with third-party services for payment processing, venue management, and event promotion, subject to their respective terms and conditions.
3. Account Registration and Security
3.1 Account Creation
To purchase tickets, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Responsibilities
You agree to:
- Provide truthful and accurate information
- Update your account information promptly when changes occur
- Maintain the security of your login credentials
- Notify us immediately of any unauthorized account access
- Accept responsibility for all activities under your account
3.3 Account Termination
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or for other legitimate business reasons. You may close your account at any time by contacting customer support.
4. Ticket Purchases and Booking Process
4.1 Booking Process
Following receipt of your booking request, we will send you a confirmation notice confirming acceptance or rejection of your booking request. A legally binding contract will be formed upon our sending of such confirmation notice or delivery of tickets.
4.2 Availability and Accuracy
We may without prior notice change the price, change or discontinue the availability or change the description of venues, seating arrangements or events for which tickets are made available. Ticket availability is subject to Event Partner allocation and technical limitations.
4.3 Booking Limits
Ticket purchases may be subject to limits per person, per credit card, or per household as determined by Event Partners. We reserve the right to cancel orders that exceed these limits.
4.4 Age Restrictions
Events may have age restrictions. You are responsible for meeting all age requirements and providing appropriate identification at venues. No refunds will be given for failure to meet age requirements clearly stated in event details.
4.5 Booking Confirmation
It is your responsibility to review the confirmation notice and ensure that ticket information is accurate before attending the event. Report any errors immediately to customer support.
5. Pricing and Payment
5.1 Price Display
Unless otherwise stated, all ticket prices displayed are in South African Rand and inclusive of VAT but exclusive of delivery fees and service charges.
5.2 Service Fees
Tickets are subject to per-ticket service fees and per-order processing fees, which are non-refundable except in cases of event cancellation.
5.3 Payment Methods
We accept major credit cards, debit cards, and other payment methods as displayed during checkout. You may only use payment methods that belong to you or to people who expressly authorize you to use such payment methods.
5.4 Payment Processing
All prices indicated will be exclusive of delivery fees which will be separately charged. In the event of a cancellation, exchange or replacement at your request, a stipulated handling fee and/or cancellation fee may apply.
5.5 Price Errors
In the case of displayed price/ticket errors, we are bound by the error price until you are informed of the error. If you act consistently with purchasing before being informed of the error, you are entitled to pay the error price.
5.6 Currency and Taxes
All transactions are processed in South African Rand. Additional taxes or duties may apply separately if applicable.
6. Ticket Delivery and Collection
6.1 Delivery Methods
Tickets may be delivered via:
- Email (print-at-home or mobile tickets)
- SMS (mobile tickets)
- Physical delivery (where available)
6.2 Delivery Responsibilities
We fulfil our commitment by emailing tickets to you. Ensure you provide accurate contact information for delivery.
6.3 Lost or Undelivered Tickets
If for any reason you are unable to collect or receive your tickets, we will not refund your purchase. Contact customer support immediately if you experience delivery issues.
6.4 Ticket Security
When you receive your tickets, please keep them in a safe place. We are not responsible for lost, stolen, damaged, or destroyed tickets.
7. Event Attendance and Venue Conditions
7.1 Venue Rules and Regulations
Tickets are issued subject to the Rules and Regulations of the venue and Event Partner. Venues reserve the right to refuse admission or eject persons who breach venue rules.
7.2 Security Searches
Venues may conduct security searches to ensure patron safety. Admission may be refused if you decline to consent to searches.
7.3 Late Arrival
Every effort will be made to admit latecomers at a suitable break in the event, but admission cannot always be guaranteed.
7.4 Event Changes
Tickets are sold subject to the venue or Event Partner's right to alter or vary the programme due to events or circumstances beyond reasonable control without being obliged to refund monies or exchange tickets.
7.5 Personal Property
The venue, Event Partner and DigiTicket accept no responsibility for any personal property.
7.6 Photography and Recording
The use of cameras, video, audio or visual recording equipment within venues is strictly prohibited. Mobile phones, pagers and digital watches must be silenced/switched off prior to entering auditoriums.
8. Prohibited Activities and Restrictions
8.1 Authorized Use Only
You are only authorized to visit, view and retain a copy of pages for your own personal use, and shall not duplicate, download, publish, modify or otherwise distribute material for any purpose other than to review event information or purchase tickets for personal use.
8.2 Commercial Use Restrictions
You may not use any area of the Platform for commercial purposes, such as to conduct sales of tickets, products or services.
8.3 Ticket Resale Prohibition
- Ticket resale above face value is illegal under South African law
- Unlawful resale or attempted resale, counterfeit or copy of tickets is grounds for seizure and cancellation without compensation
- We may cancel orders suspected of being for resale purposes
8.4 Prohibited Technologies
You may not use any device, program or service designed to circumvent technological measures that control access to the Platform or Content, including by manual or automatic device or process.
8.5 Account Misuse
- Create multiple accounts to circumvent purchase limits
- Use false information during registration or purchase
- Share account credentials with others
- Engage in fraudulent or deceptive practices
9. Intellectual Property Rights
9.1 Platform Ownership
All materials on our Platform are copyrighted and protected under treaty provisions and worldwide copyright laws. Materials may not be reproduced, copied, edited, published, transmitted or uploaded without our written permission.
9.2 Limited License
We grant you a limited, conditional, no-cost, non-exclusive, non-transferable, non-sublicensable license to view this Platform and its Content for non-commercial purposes only.
9.3 Trademark Protection
The registered and unregistered trademarks, logos and service marks displayed are owned by us or our licensors. You may not use our trademarks without prior written permission.
9.4 User Content
Any content you submit to our Platform remains your property, but you grant us a non-exclusive license to use, display, and distribute such content for Platform operations.
9.5 Copyright Infringement
We will terminate privileges of any user who unlawfully transmits copyrighted material. Users who submit Content must ensure it doesn't infringe copyrights or other rights of third parties.
10. Liability and Risk Allocation
10.1 Limitation of Liability
We will not be liable for any damages of any kind arising from use of the Platform, including direct, indirect, incidental, punitive and consequential damages.
10.2 Platform Disclaimers
We do not promise that the Platform will be error-free, uninterrupted, nor that it will provide specific results. The Platform and Content are delivered "as-is" and "as-available".
10.3 Third-Party Liability
We disclaim liability for acts, omissions and conduct of third-party users, Event Partners, advertisers and sponsors. We are not responsible for products, services, actions or failure to act of any venue, performer, promoter or other third party.
10.4 Event Partner Responsibilities
We accept no responsibility or liability on behalf of or jointly with Event Partners for any loss, damages or injury suffered by third parties because of events.
10.5 Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or technical failures.
11. Indemnification
11.1 User Indemnification
You agree to indemnify and hold us, our officers, agents, partners and employees harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Platform.
11.2 Scope of Indemnification
This includes but is not limited to claims arising from:
- Your violation of these Terms
- Your infringement of intellectual property rights
- Your violation of applicable laws
- Your negligent or wrongful conduct
12. Consumer Protection Act Compliance
12.1 South African Consumer Rights
These Terms comply with the South African Consumer Protection Act. Terms may not be unfair, unreasonable or unjust, and must be in plain language that is easy to understand.
12.2 Consumer Protection Limitations
Certain Consumer Protection Act provisions, including section 17 (right to cancel advanced reservations), section 47 (overselling and overbooking) and section 49 (notice requirements) are acknowledged and incorporated.
12.3 Right to Fair Terms
Any agreement terms that are unfair, unreasonable and unjust will not be legally binding. Terms may not only favour the supplier.
12.4 Plain Language Requirement
This agreement is written in plain language that is easy to understand. You are entitled to a copy of this agreement.
13. Refunds and Exchanges
13.1 General Policy
Policies set forth by Event Partners prohibit us from issuing exchanges or refunds after a purchase has been made, except in specific circumstances outlined in our Refund Policy.
13.2 Event Cancellation
If events are cancelled, refunds will be automatically processed to your payment method within 3-7 working days after confirmation.
13.3 Event Postponement
For postponed events, you may hold tickets for the new date or request a full refund if you cannot attend the new date.

14. Data Protection and Privacy
14.1 Privacy Policy Integration
Your personal information is collected, used, and protected in accordance with our Privacy Policy, which forms an integral part of these Terms.
14.2 POPIA Compliance
You agree that information gathered relating to ticket purchasers, including identity, contact details and banking details, shall not be used for any purpose other than that for which the information was given and shall not be sold or transferred to third parties without consent.
14.3 Consent to Processing
By using our Platform, you consent to the collection and processing of your personal information as described in our Privacy Policy.
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by South African law. Any disputes will be resolved in the appropriate South African courts.
15.2 Consumer Protection Remedies
You may lodge complaints with the National Consumer Commission or National Consumer Tribunal for Consumer Protection Act violations.
15.3 Alternative Dispute Resolution
We encourage resolution of disputes through our customer service channels before pursuing formal legal action.
15.4 Limitation Period
Any claims must be brought within the applicable limitation periods under South African law.
16. Communication and Notifications
16.1 Electronic Communications
We may monitor and keep records of communications sent via our Platform for lawful purposes, including filtering to prevent transmission of unlawful content.
16.2 Marketing Communications
You may receive marketing communications about events and offers. You can opt-out at any time through your account settings or unsubscribe links.
16.3 Important Notices
We may send important notices about your account, purchases, or changes to these Terms via email or Platform notifications.
17. Technical Terms
17.1 System Requirements
Use of our Platform requires compatible devices and internet connectivity. We are not responsible for technical issues with your devices or internet service.
17.2 Platform Availability
While we strive for continuous availability, the Platform may be temporarily unavailable for maintenance, updates, or due to technical issues.
17.3 Security Measures
We implement reasonable security measures but cannot guarantee absolute security. Users share responsibility for protecting their account information.
18. Miscellaneous Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between the parties and override any contrary terms incorporated by you.
18.2 Severability
If any portion of this agreement is held unenforceable by any competent authority, the unenforceable portion will be construed as nearly as possible to reflect the original intentions, and the remainder will remain in full force.
18.3 Waiver
Our failure to enforce any provision strictly will not be construed as a waiver of any provision or right.
18.4 Assignment
We may assign these Terms or any rights hereunder without your consent. You may not assign your rights under these Terms without our written consent.
18.5 Survival
Provisions that by their nature should survive termination will continue in effect after termination of these Terms.
